3. User Accounts

3.1 Account Creation

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LESSON LASSO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

• Loss of profits, data, use, or goodwill
• Service interruption or loss of access
• Damages resulting from your use or inability to use the Service
• Damages resulting from any content generated through the Service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10.1 Australian Consumer Law

FOR AUSTRALIAN USERS: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (ACL) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

Subject to the ACL, our liability for any breach of a consumer guarantee is limited, at our option, to:

• In the case of services: supplying the services again, or paying the cost of having the services supplied again
• In the case of goods: replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of having the goods repaired or replaced

You agree to indemnify, defend, and hold harmless Lesson Lasso and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content

The Service may contain links to third-party websites or services that are not owned or controlled by Lesson Lasso. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

• Australian users: Laws of the State of New South Wales, Australia
• European Union users: Laws of Ireland and EU regulations

16.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through:

16.3 Australian Users - Jurisdiction

For Australian users, any legal proceedings shall be subject to the non-exclusive jurisdiction of the courts of New South Wales, Australia. Nothing in these Terms affects your rights under the ACL or other applicable consumer protection laws.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lesson Lasso regarding the Service and supersede all prior agreements and understandings.
